These Terms of Service ("Terms") govern your use of the FutureZMinds platform and services. By accessing or using our services, you agree to be bound by these Terms.

1. Services

FutureZMinds provides a WhatsApp-based business automation platform that includes appointment booking, automated reminders, marketing campaigns, and customer engagement tools. Our services are delivered through the WhatsApp Business Cloud API provided by Meta Platforms, Inc.

2. Eligibility

• You must be at least 18 years old to use our services.
• You must have a valid business and the legal authority to bind that business to these Terms.
• You must comply with Meta's WhatsApp Business Policy and Commerce Policy.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate business information during registration.
• You must promptly notify us of any unauthorized access to your account.

4. Acceptable Use

You agree NOT to:

• Send spam, unsolicited messages, or bulk messages without recipient consent
• Use our platform for illegal, harmful, or fraudulent purposes
• Violate WhatsApp's Business Messaging Policy or Terms of Service
• Attempt to reverse-engineer, copy, or resell our platform
• Share your account access with unauthorized third parties
• Use the platform to collect or store sensitive health data beyond what is necessary for appointment management

5. WhatsApp Compliance

Our services operate through the WhatsApp Business Cloud API. You acknowledge that:

• WhatsApp messaging is subject to Meta's policies and pricing
• Message delivery is dependent on WhatsApp's infrastructure and availability
• WhatsApp template messages require approval from Meta before use
• We are not responsible for WhatsApp service disruptions or policy changes by Meta

6. Payment Terms

• Free tier services are provided at no charge with usage limits as specified on our pricing page.
• Paid plans are billed monthly in Indian Rupees (INR).
• WhatsApp conversation charges (as billed by Meta) are separate from our platform fees.
• All fees are non-refundable unless otherwise stated.
• We reserve the right to modify pricing with 30 days' notice.

7. Data Ownership

• You retain ownership of all business data, customer data, and content you upload to our platform.
• We do not claim ownership of your data.
• You grant us a limited license to process your data solely for providing our services.
• Upon account termination, you may request export of your data within 30 days.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for:

• Scheduled maintenance downtime (notified in advance)
• Service disruptions beyond our control (internet outages, WhatsApp outages, etc.)
• Data loss due to events outside our reasonable control

9. Limitation of Liability

To the maximum extent permitted by law, FutureZMinds shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

• You may terminate your account at any time by contacting us.
• We may suspend or terminate accounts that violate these Terms or WhatsApp's policies.
• Upon termination, your access to the platform will cease and data will be retained for 30 days before deletion.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
